1. Agreement to Terms

By accessing or purchasing from Scoops of Whimsy (“the Store”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, and any policies displayed on our website. If you do not agree, please discontinue use immediately.


2. Services Provided

Scoops of Whimsy offers stationery-themed mystery boxes and curated gift items. We do not sell digital video products.
A limited number of mystery box orders may be randomly selected for social media unboxing videos. If your order is selected for a video feature:

  • We will only reference your first name, and no surname, contact details, location, or any other personal information will be disclosed

  • Selection is random, not guaranteed, and cannot be requested

  • You are not obligated to share personal audio, appear on camera, or provide additional information

  • The video feature is intended for brand storytelling and community engagement only


3. Eligibility and Minors

  • You must be at least 18 years old or the legal age of majority in South Africa to place an order.

  • We do not knowingly contract with minors without parental or guardian consent.

  • If a minor accesses the Store, the account holder or parent/guardian assumes responsibility.


4. Pricing and Payments

  • All prices are displayed in South African Rand (ZAR) and include VAT where applicable.

  • Payments are securely processed by third-party Payment Service Providers (PSPs) such as PayFast, Ozow, Yoco, PayFlex, Peach Payments, or others integrated into our checkout.

  • We do not store card or banking details directly. We receive only transaction references and payment confirmations.

  • Prices, product descriptions, and availability may change without notice.

  • In the event of pricing errors, we reserve the right to cancel or refund affected orders.


5. Orders and Fulfilment

  • Order acceptance occurs once payment is confirmed.

  • We reserve the right to refuse or cancel orders due to fraud risk, stock limitations, or policy violations.

  • Mystery box contents are randomized by design and cannot be guaranteed to match specific item requests unless explicitly stated in a product listing.


6. Shipping and Delivery

Shipping is governed by our Shipping Policy. Key points:

  • Non-video orders: Delivered in 3–5 working days after dispatch

  • Orders selected for social media unboxing: Dispatched within 5–10 working days

  • Physical addresses required (no PO boxes)

  • Tracking numbers provided where supported

We are not liable for delivery delays caused by third-party couriers.


7. Returns, Refunds, and Replacements

  • Returns are handled in line with the Consumer Protection Act 68 of 2008 (CPA).

  • Due to the randomized nature of mystery boxes, we do not accept returns based solely on customer preference of box contents.

  • We accept returns or provide replacements when products arrive damaged, defective, or incorrect.

  • Damage claims must be submitted within 48 hours of delivery with photos.

  • Approved refunds are processed back through the original PSP or store credit.

  • Video selection is not a service you are purchasing, and cannot be used as grounds for returns or refunds

8. Prohibited Use

You agree not to:

  • Use the Store for illegal or fraudulent purposes

  • Attempt to breach, disrupt, or exploit our website, servers, or services

  • Scrape, resell, or reproduce content without permission

  • Upload malicious code, bots, or harmful software


9. Account Responsibility

If you create an account:

  • You are responsible for keeping credentials secure

  • You agree not to share access with unauthorized users

  • Notify us immediately if you suspect compromise


10. Intellectual Property

All content including text, images, branding, product names, designs, and materials on the Store are owned by or licensed to Scoops of Whimsy. You may not copy, redistribute, or reuse any content for commercial purposes without written consent.

Social media content, including unboxing videos, remains the property of Scoops of Whimsy.


We will never publish identifying information beyond a first name, where applicable.


11. Disclaimers

  • Products are provided “as is” and “as available”

  • We do not guarantee that the Store will operate uninterrupted or error-free

  • We are not liable for indirect damages, loss of profits, or consequential damages arising from Store use


12. Limitation of Liability

To the fullest extent permitted under South African law, Scoops of Whimsy, including its operators, employees, partners, and service providers, shall not be liable for any claim exceeding the value of the purchased goods or services.


13. Governing Law

These Terms are governed by the laws of the Republic of South Africa, including:

  • Protection of Personal Information Act (POPIA)

  • Consumer Protection Act (CPA)

  • Electronic Communications and Transactions Act 25 of 2002 (ECTA)


14. Disputes and Resolution

Should a dispute arise:

  1. You agree to first contact us directly to resolve it

  2. If unresolved, the matter may be referred to mediation or appropriate South African consumer/legal channels

  3. Complaints related to personal information may also be lodged with the Information Regulator of South Africa


15. Amendments

We may update or amend these Terms at any time to reflect business, legal, or operational changes. Continued use of the Store constitutes acceptance of the updated Terms.
